1. About these terms
These terms govern use of www.specandsource.co.uk and purchases made through the website. By using the website or placing an order, you agree to these terms. If you do not agree, please do not use the website.
The website is operated by Charlotte Pritchard, a sole trader trading as Spec + Source.

2. Who may use the website
You must be at least 18 years old and legally capable of entering a contract to purchase from the website. If you purchase for a business, you confirm that you have authority to bind that business. Nothing in these terms removes rights that cannot lawfully be excluded.
3. Website information
We take reasonable care to keep website information accurate and current, but packaging materials, supplier capabilities, costs, lead times, regulations and technical requirements can change. General website content and free resources are provided for information and do not constitute project-specific packaging, legal, regulatory, financial or other professional advice.
You remain responsible for checking specifications, artwork, compliance, testing, suitability, quotations and production decisions with appropriately qualified suppliers and advisers for your particular product and market.
4. Products, prices and availability
Product descriptions, inclusions, format, compatibility and prices are shown on the relevant product page. Prices are displayed in pounds sterling unless stated otherwise and include applicable taxes where required. We may change prices or products prospectively, but this will not affect an order already accepted.
We may correct an obvious pricing or description error before accepting an order. If payment has already been taken for an order we cannot accept, we will refund it.
5. Orders and contract formation
Your order is an offer to purchase. A binding contract is formed when we send an order confirmation or otherwise make the purchased digital content available, whichever occurs first. Please check your email address and order details before submitting the order and contact us promptly if they are incorrect.
6. Payment
Payment is taken through the payment methods shown at checkout, which may include PayPal or another provider. Payment providers may apply their own terms and privacy information. You confirm that you are authorised to use the selected payment method.
7. Digital products
Digital products are supplied under the Digital Product Policy and Licence below, which forms part of these terms. The product page will describe the files, access method and any third-party account or software needed.
8. Consultancy services
Website enquiries, discovery discussions or purchases of digital products do not create a consultancy engagement. Consultancy services are governed by a separate written proposal, scope, quotation or service agreement. If there is a conflict, the project-specific agreement takes priority for those services.
Unless expressly agreed in writing, Spec + Source is an independent consultant and does not manufacture packaging, act as a supplier's agent, guarantee supplier performance or take responsibility for a manufacturer's production processes.
9. Intellectual property
The website and its text, graphics, branding, downloads, templates and other materials are owned by or licensed to Spec + Source and protected by intellectual-property law. You may view the website and make reasonable personal or internal-business use of its public content. You must not reproduce, scrape, republish, sell, licence, distribute or commercially exploit it without prior written permission, except where law permits.
10. Acceptable use
You must not misuse the website; attempt unauthorised access; introduce malicious code; interfere with security or operation; use automated extraction in a way that burdens the site; infringe another person's rights; or use the website for unlawful, misleading or fraudulent activity.
11. Third-party services and links
The website may use or link to third-party services, including Wix, Canva, PayPal, Google and Pinterest. We do not control third-party platforms and are not responsible for their independent content, availability, security, policies or changes. Use of them may be subject to separate terms.
12. Availability and changes
We may update, suspend or withdraw parts of the website for maintenance, security or business reasons. We do not promise uninterrupted access. This does not affect obligations for an accepted order or your statutory rights.
13. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
If you are a consumer, we are responsible for losses that are a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable or for business losses where you purchased wholly or mainly for personal use.
If you purchase in the course of business, to the fullest extent permitted by law we will not be liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, anticipated savings, goodwill or data. Our total aggregate liability arising from a digital-product order will not exceed the amount paid for that order, except where liability cannot lawfully be limited. Any different allocation of risk for consultancy services will be set out in the project-specific agreement.
14. Events outside reasonable control
We are not responsible for delay or failure caused by events outside our reasonable control. We will take reasonable steps to minimise the effect and will communicate with you where an accepted order is materially affected.
15. Ending access
We may restrict access or terminate a digital-product licence where you materially breach these terms or the licence. Clauses intended to continue, including intellectual property and accrued rights, will survive termination.
16. Transfer and third-party rights
You may not transfer your rights under these terms without our written agreement. We may transfer our rights and obligations where this does not reduce protections available to you. No person other than you and Spec + Source has a right to enforce these terms, except a permitted successor.
17. Severability and waiver
If any provision is found invalid or unenforceable, the remaining provisions continue. A delay in enforcing a right does not waive it.
18. Governing law and disputes
These terms are governed by the laws of England and Wales. If you are a consumer, you may also have mandatory rights under the law where you live and may bring proceedings in any court available to you under applicable consumer law. If you purchase in the course of business, the courts of England and Wales will have exclusive jurisdiction.
